Un débat public de fond semble s’engager dans notre pays, à travers la presse notamment sur le rôle du wali au sein des collectivités locales. Bien qu’ancien, ce débat mérite un réflexion ardente, tant les enjeux sont considérables. En effet, il pose le problème des équilibres du pouvoir local en Algérie entre les élus du peuple (P/APC et P/APW) et les représentants du pouvoir exécutif (wali, chef de Daïra, secrétaire général communal). Le dossier relatif à la réforme des collectivités locales étant en discussion, pour l’instant, il aurait été judicieux d’attendre ses conclusions et recommandations. Or, subrepticement le débat se construit hors des canaux légaux (pouvoirs législatifs) et à travers des « experts » qui opinent sur ce thème sensible, en proposant de transformer les représentants locaux de l’état, en « manager » des dépenses publiques, qui relèvent de la comptabilité publique et non du droit commercial ! Au-delà de l’illégalité de la démarche, le problème de la responsabilité civile, pénale et financière de ces fonctionnaires, se pose dans toute sa dimension. En effet, les carences, plusieurs fois relevées dans la gestion des collectivités locales (dépenses et recettes), sont à imputer aux pouvoirs, attributions et prérogatives, concédés par la loi, aux élus locaux, qu’à leurs capacités managériales. S’agissant des programmes spéciaux inscrits au titre de certaines wilayas, ils échappent aux règles de la comptabilité, par des dérogations spéciales, qu’il ne faut pas confondre avec la gestion courante. Attendons donc les conclusions de la commission de la réforme des collectivités locales.
